The Clap
The saga continued this week as both Musk and Twitter (TWTR) both provided legal filings that attack one another.
The Deets
In preparation for the trial in October, Musk’s lawyers released legal documents that accuse Twitter of giving false numbers in financial filings with the SEC. Musk believes that Twitter is filing better numbers in order to attract and reassure investors.
Twitter falsified these claims, arguing that he is looking for an excuse to back out of the acquisition.
More Detailed View
Musk claims SEC filings were inaccurate to which Twitter responded that Musk tried to find a problem and found nothing.
Musk also believes that Twitter does not explain how they derive monetized daily active users (mDAU), to which Twitter responded that they accurately explain how it is derived in SEC filings.
Both sides have been on the offensive as they try to build up their case for the trial in October.
